These Terms of Use ("Terms") govern your use of the Never-2-Far websites at never-2-far.com and draft.never-2-far.com. Never-2-Far is jointly operated by Neu N Optimal PLT (Malaysia, Business Reg. PT 60575327100) and Cirra Edge Pte Ltd (Singapore). When these Terms say "we", "us", or "Never-2-Far", we mean both entities together. By using our site, you agree to these Terms.

1. Who we are

Never-2-Far is a memorial visitation service that arranges trained representatives to visit memorial sites on behalf of families who cannot be physically present. We are operated jointly by Neu N Optimal PLT (Malaysia) and Cirra Edge Pte Ltd (Singapore), with planned service availability in Klang Valley and Singapore from Q2 2026.

Both entities are part of the same operating group. Either entity may communicate with you, deliver service to you, and exercise rights or obligations under these Terms. A single point of contact serves both entities: care@never-2-far.com.

2. Pre-launch status

Our service is not yet operating. The website is currently used to collect expressions of interest from prospective families and partners ahead of our planned Q2 2026 launch. Submitting an Express Interest form is not a booking, does not create a contract for service, and does not obligate either of us to anything beyond what is described in these Terms and our Privacy Policy.

3. Eligibility

You must be at least 18 years old to use this website. By using the site or submitting any form, you confirm that you meet this requirement.

4. What you're agreeing to

By using this site and by ticking the consent box on any form, you agree:

• To provide accurate information in any form you submit.
• That you have the right to share any information you provide (including any names or details of deceased persons referenced).
• That both Neu N Optimal PLT (Business Reg. PT 60575327100, Malaysia) and Cirra Edge Pte Ltd (Singapore) may store, use, and process the personal information you submit, for the purposes described in our Privacy Policy.
• To receive communications from us in response to your inquiry, and (only if you tick the consent box) to receive marketing communications about our launch and offerings.
• To use the site for its intended purpose only.

You can withdraw consent and request removal of your personal information at any time, for any reason, by emailing care@never-2-far.com. We will action removal requests within 7 working days. We retain your information for 90 days from your last interaction with us by default, after which it is deleted automatically. Full retention and removal details are in our Privacy Policy.

5. Acceptable use

You may not:

• Submit false, misleading, or fraudulent information.
• Submit any form on behalf of someone else without their permission.
• Attempt to access systems, data, or accounts you are not authorised to access.
• Scrape, copy, or reproduce material from the site beyond fair personal use.
• Use the site to harass, defame, or harm any person.
• Disrupt, attempt to disrupt, or probe the security of our systems or our service providers' systems.

6. Communications

By submitting an Express Interest form and ticking the consent box, you agree that we may contact you by email or phone (if provided) about your inquiry and about our service launch. You can withdraw consent at any time by emailing us using the contact details below. Withdrawal of consent does not affect any communications already in progress.

7. Intellectual property

All content on this website, including text, design, photographs, graphics, and code, is owned by Neu N Optimal PLT and/or Cirra Edge Pte Ltd, or used with permission from rightful owners. You may not copy, reproduce, modify, or distribute our content without our written permission, except as permitted by applicable copyright law (such as fair use or fair dealing).

8. Disclaimers

The website is provided "as is" and "as available". We make no guarantees that the site will be available without interruption, error-free, or secure against all threats. We make no guarantees about the timing, scope, pricing, or availability of our future paid service — service plans may change at our discretion before launch.

Any information on the site about our planned service is for informational purposes only and does not constitute a binding offer, contract, or commitment.

9. Limitation of liability

To the maximum extent permitted by applicable law, Neu N Optimal PLT, Cirra Edge Pte Ltd, and their respective partners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the website or from any inability to use the website.

For any direct damages that are not excluded by law, our total liability is limited to the greater of (i) the amount you have paid us in the past 12 months (which, prior to service launch, will be zero), or (ii) RM 100.

10. Termination

We may suspend or terminate your access to the site at any time, with or without notice, if we believe you have violated these Terms or applicable law. You may stop using the site and withdraw any consent you have given at any time.

11. Governing law and disputes

These Terms are governed by the laws of Malaysia, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the site will be brought exclusively in the courts of Kuala Lumpur, Malaysia, unless applicable consumer-protection laws in your jurisdiction require otherwise.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will use reasonable efforts to notify you in advance. Your continued use of the site after changes take effect constitutes your acceptance of the updated Terms.
